In stark opposition to Broaddrick’s claim, Justice Jackson, the first Black woman to sit on the Supreme Court, was nominated by President Biden and confirmed with bipartisan support by the Senate in 2022, following all the requisite constitutional formalities. Several who opposed her stated she was “duly nominated by the Chief Executive and approved by the Senate.” Another sarcastic detractor questioned if she was suffering from “sore loser syndrome.” The chatter began to branch out toward other justices, with one commentator actually suggesting that Barrett and Kavanaugh also be reconsidered. They serve for life and may be removed only if impeached by the House of Representatives and convicted by the Senate for “Treason, Bribery, or other high Crimes and Misdemeanors.” There is no precedent in history in which a justice has ceased to act on grounds questioning the legitimacy of their appointment process.
