Lawyers argue Johnny and Matthew Gaudreau's blood alcohol levels shouldn't be used as evidence in the trial surrounding their deaths
The blood alcohol levels of Johnny and Matthew Gaudreau should not be allowed as evidence when the trial of their alleged killer begins, argued the brothers’ attorneys. Johnny, 31, and Matthew, 29, were struck and killed by alleged drunk driver Sean M. Higgins in August 2024 while riding bicycles in Oldmans Township, New Jersey the night before their sister Katie Gaudreau ’s wedding. “We believe these filings are essential to ensuring that our client’s Constitutional rights are protected and that he is not being treated unfairly based upon the amount of publicity being garnered,” Higgins’ attorneys, Richard F. Klineburger III and Matthew V. Portella, said in a statement obtained by NJ.com.
